Terms of Service

Thank you for choosing Ruff Title! These Terms of Service ("Terms") govern your use of our mobile applications (the “App”), related services, and our website (the "Website”) (collectively, the "Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms. Please read them carefully.

1. Eligibility

You may use the Services only if you
a) can form a binding contract with Gallatin Applications LLC and are not barred under any applicable laws from doing so
b) meet minimum age requirements - see age requirements below
c) agree to Third Party Terms - see section “9. Third Parties” below

Age Requirements: You must be 13 years of age or older to use these Services. If you are 13 or older, but under the age of majority in your jurisdiction, you must review this agreement with your parent or guardian to make sure that you and your parent or guardian understand it. Parents and guardians are jointly and severally liable for all acts and omissions of their children aged under majority when using the Services.

2. Intellectual Property

The Services and its content, including but not limited to text, graphics, images, logos, and software, are protected by intellectual property laws and are the property of Gallatin Applications LLC or its licensors. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, or store any of the content without our express prior written consent.

3. Grant of Limited License

Your access to the Services is licensed and not sold. Subject to these Terms, Gallatin Applications LLC hereby grants you a revocable, non-exclusive, non-transferable account enabling you to access and use the Services. All the content that is made available to view and/or download in connection with any of the Services is owned by and is the copyrighted work of Gallatin Applications LLC and/or its licensors and is licensed, not sold. You do not have the right to lend, lease, rent or sublicense any of the Services.

4. Use Restrictions

You agree NOT to:

  • Use the Services in any manner that violates any applicable laws or regulations.
  • Impersonate any person or entity or falsely state your affiliation with a person or entity.
  • Authorize any third party to access and/or use the Services on your behalf using any automated process such as a BOT, a spider or periodic caching of information stored by the Services on your behalf without a separate written agreement with Gallatin Applications LLC.
  • Interfere with or disrupt the operation of the Services or systems connected to it.
  • Attempt to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services.
  • Reverse engineer, decompile, disassemble, attempt to derive the source code, or create derivative works of the Services.
  • Sell, distribute, rent, lease, sublicense or otherwise transfer the Services to a third party.

5. User-Generated Content

You may submit content, including text, images, and other materials, to the Services ("User-Generated Content"). By submitting User-Generated Content, you represent and warrant that you have the necessary rights to submit and use this data.

You agree that Gallatin Applications LLC shall not be responsible or liable for any User-Generated Content that violates any applicable laws, regulations, or third-party rights. You acknowledge that you are solely responsible for the legality, accuracy, and appropriateness of any content you submit.

6. Privacy

When you use our Services, we may collect certain information from you, including your name and email address. We are committed to protecting your privacy. For more information on exactly how we use your information see our Privacy Policy at www.rufftitle.com/privacy.

7. Purchases and Payments

To access certain features and content within the Services, you may be required to make an additional purchase. Any purchase will be processed through the respective platforms app stores (iOS App Store or Google Play Store). You agree to abide by the terms and conditions of these platforms app store provider when making any purchase through the Services.

8. Refunds, Cancellations, and Trials

Ruff Title subscriptions may offer a free trial period. During the free trial period, you have the option to cancel your subscription before it is billed. If you don't want to renew it, you must cancel it at least 24 hours before the trial ends.

  • Once a subscription charge has been billed, it is non-refundable.
  • Subscriptions automatically renew unless you cancel them.
  • If you are currently on a plan that has been billed, you are responsible for those charges.
  • You can cancel future billing at any time up to 24 hours before the next billing date.
  • If you cancel, you can keep using the subscription until the next billing date.

9. Third Parties

The Services may require access to other third party services, including but not limited to authentication or billing services. Your right to use our Services is also predicated on your compliance with any applicable terms of service, terms of use, and privacy policies you have agreed and accepted with third parties (Third Party Terms). Applicable third parties (such as your social OAuth providers, mobile phone, or internet access account provider) may also impose limits on the use of or access to certain Services, in any case and without notice or liability. You agree that Gallatin Applications LLC shall not be liable for any acts or omissions of such third parties.

10. Updates to our Services

The Services which you use may from time to time automatically download and install updates from Gallatin Applications LLC. These updates are designed to improve, enhance and further develop the Services and may take the form of bug fixes, enhanced functions, or entirely new versions of the Services. You agree that Gallatin Applications LLC may automatically deliver such updates to you as part of your use of the Services and you shall receive and install them as required.

We reserve the right to modify, suspend, or discontinue the Services, or any part of it, at any time without notice.

11. Limitation of Liability

To the extent permitted by applicable law, Gallatin Applications LLC and its members shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

12. Updates to these Terms

Please note that these Terms of Service may change from time to time. You understand and agree that use the Services after the date on which these Terms have changed constitutes your acceptance of the revised Terms. We may notify you of any material changes by posting the updated Terms on our website or by other means. If you do not comply with these Terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).

13. Miscellaneous

This Agreement shall be governed by and construed in accordance with the laws of the State of Montana. You agree that any legal action or proceeding between Gallatin Applications LLC and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Yellowstone County, Montana, United States. Any cause of action or claim you may have with respect to Gallatin Applications LLC  must be commenced within one (1) year after the claim or cause of action arises. Gallatin Applications LLC’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. No waiver of any term, provision or condition of this Agreement, whether by conduct or otherwise, in any one or more instances, shall be deemed to be, or shall constitute, a waiver of any other term, provision or condition hereof, whether or not similar, nor shall such waiver constitute a continuing waiver of any such term, provision or condition hereof. No waiver shall be binding unless executed in writing by the party making the waiver.  This Agreement constitutes the complete and exclusive statement of the agreement between the parties with respect to the Services and supersedes any and all prior or contemporaneous communications, representations, statements and understandings, whether oral or written, between the parties concerning the Services.The provisions of this Agreement are severable, and in the event any provision hereof is determined to be invalid or unenforceable, such invalidity or unenforceability shall not in any way affect the validity or enforceability of the remaining provisions hereof. Gallatin Applications LLC may assign its rights and duties under this Agreement to any party at any time without notice to you.
